San Francisco Personal Injury Attorney On The Supreme Court's ...

Monday (10/1) marks the start of the Supreme Court?s new term.

What issues can we expect the Court to address this term?

Decisions on affirmative action, criminal justice, the right to counsel and representation, and voting rights decisions to name a few.

Right to an attorney.

There are two cases on the Courts docket regarding a defendant?s right to have effective assistance of counsel in a criminal matter. One is Ryan v. Gonzales and the other is Chaidez v. United States. In Ryan, the question before the Court is whether the defendant must be mentally capable of assisting his attorney when challenging a death penalty conviction. The issue in Chaidez is whether an attorney must advise their client, if he is a non-citizen, that a guilty plea in their case entails the risk of deportation.

Affirmative action.

Fisher v. University of Texas at Austin the Court will, once again, decide in the context of this case whether a school can take race into consideration in student admissions.

Unreasonable searches.

The Court takes a look at the reasonableness of a search in two different cases. In Florida v. Jardines, the Court addresses the question of whether using a police dog to sniff for marijuana at the door of a house where pot was suspected of being grown is unreasonably intrusive. And Missouri v. McNeely, in which the police ordered a blood test of a man suspected of being drunk without obtaining a warrant.

And the Court has not yet decided whether it will decide important cases on voting rights and the Defense of Marriage Act.

In any event, we will be watching.
